Terms and Conditions
1. Overview
These Terms and Conditions ("Terms") govern the provision of custom foot orthotics ("Orthotics") by Gait Werx Incorporated ("Gait Werx"). By purchasing or receiving Orthotics from Gait Werx, you agree to be bound by these Terms.
Please note that Gait Werx does not provide medical diagnoses, treatments, or procedures. Our services are intended to support general wellness and improve comfort in activities of daily living. The custom Orthotics we produce are based on biomechanical assessments and do not require a medical prescription.
2. Customization Process
- All orthotics are custom-fabricated based on individual assessment, which may include 3D scanning, casting, photos, videos, gait analysis and a biomechanical evaluation.
- Orthotics are tailored to the client’s specific condition, foot structure, and lifestyle at the time of assessment.
- Any significant changes in health, weight, footwear, or activity level after assessment may affect orthotic fit and/or function.
3. Payment Policy
- Full payment is required upon order unless otherwise agreed in writing.
- We accept Visa, Mastercard, American Express Discover, Debit and HSA/FSA, Insurance where applicable.
- Custom orthotics are non-refundable once fabrication has started.
4. Satisfaction Guarantee
We stand behind the quality and comfort of our orthotics.
- If you are not satisfied with the fit or comfort of your orthotics, you may return for an adjustment within 60 days of the delivery date.
- Up to two (2) adjustments are included at no additional cost within the first 60 days.
- If, after reasonable adjustments, you are still not satisfied, we may offer a remake or credit at our discretion. No full refunds will be issued due to the custom nature of the product.
5. 90-Day Warranty – Materials & Workmanship
- Your orthotics are covered by a 90-day limited warranty from the date of delivery.
- This warranty covers manufacturing defects in materials or workmanship.
- The warranty does not cover:
- Normal wear and tear
- Damage from misuse, improper care, or alterations by a third party
- Changes in foot structure or health after fabrication
Warranty claims must be submitted with proof of purchase and returned orthotics for evaluation.
6. Returns and Exchanges
- As custom orthotics are made to your unique specifications, they are not eligible for return or refund unless covered under our satisfaction guarantee or 90-day warranty.
- We do not accept returns for orthotics damaged due to neglect, improper use, or exposure to heat, water, or pet damage.
7. Break-in Period and Adjustments
- A break-in period of 1–2 weeks may be required. Minor discomfort during this time is normal.
- Clients are encouraged to wear orthotics for short periods initially (1 hour on the 1st day, 2 hours on the 2nd day, etc.), gradually increasing wear time. Clients can increase wear time by their own discretion if orthotics are comfortable and help with their needs.
- If discomfort persists, please contact customer service and schedule a remote adjustment appointment with our orthotist or orthotic specialist within 30 days of receipt.
8. Care Instructions
- Keep orthotics dry and clean. Wipe with a damp cloth when needed.
- Do not machine wash or expose to heat sources (e.g., dryers, car dashboards).
- Store in a cool, dry place when not in use.
9. Insurance and Reimbursement
- We do not bill insurance for orthotics.
- A medical prescription is not necessary.
- We can provide detailed invoices and documentation to assist with insurance reimbursement.
- We do not guarantee approval or reimbursement by any insurance provider.
- It is the client’s responsibility to verify coverage before ordering if they are submitting individually to insurance.
10. Limitation of Liability
- Gait Werx, Incorporated is not liable for injuries, conditions, or complications resulting from misuse, non-compliance, or health changes.
- Orthotics are intended to assist with support and function but are not a guaranteed cure for medical conditions.
11. Governing Law
These Terms are governed by the laws of California and any disputes shall be resolved under its jurisdiction.
Privacy Policy
At Gait Werx Incorporated (“Gait Werx,” “we,” “us,” or “our”), we are committed to protecting the privacy and security of your personal and health information. This Privacy Policy describes how we collect, use, protect, and disclose your information when you engage with our services, including the design and provision of custom foot orthotics based on personal health data.
We are committed to maintaining compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and other applicable privacy regulations.
1. Information We Collect
In order to create and deliver customized orthotic solutions, Gait Werx may collect the following types of information:
a. Personal Information
- Full name
- Contact information (email, phone number, address)
- Date of birth
- Height, weight, shoe style and size
b. Protected Health Information (PHI)
As defined by HIPAA, PHI may include:
- Medical history and diagnoses
- Notes from referring healthcare providers
- Information related to foot and gait health
- Health assessment forms
c. Biomechanical and Imaging Data
- Foam box impressions
- 2D and 3D scans of feet and lower limbs
- Photos and videos of walking and/or running gait and as need additional outcome measure tests
- Motion capture data
- Gait and postural analysis reports
2. How We Use Your Information
We use your information for the following purposes:
- To evaluate your needs for orthotics and related biomechanical services
- To design and fabricate custom orthotic devices
- To communicate with you regarding appointments, updates, or inquiries
- For internal research and product improvement (in de-identified form)
- To comply with applicable laws, regulations, and professional standards
3. HIPAA Compliance
Gait Werx complies with the HIPAA Privacy Rule and Security Rule when handling Protected Health Information. We implement physical, technical, and administrative safeguards to protect the confidentiality, integrity, and availability of PHI.
All PHI is:
- Stored securely with encryption and restricted access
- Only accessed by trained personnel with a legitimate need to know
- Disclosed to third parties only with written authorization, unless required or permitted by law
We may share PHI with your referring healthcare provider or insurance carrier, but only with your consent or as otherwise allowed under HIPAA.
4. Data Storage and Security
We utilize secure electronic systems and locked storage for physical records to protect your data. Some information may be stored on cloud platforms that comply with HIPAA and relevant privacy standards.
Security measures include:
- Password-protected systems
- Encrypted communications and storage
- Routine backups
- Employee training on privacy practices
5. Your Rights Under HIPAA
You have the following rights regarding your health information:
- Right to Access: You may request a copy of your health records.
- Right to Amend: You may request corrections to your health data.
- Right to an Accounting of Disclosures: You can request a record of disclosures made of your PHI.
- Right to Request Restrictions: You may request limitations on how your data is used or shared.
- Right to Confidential Communications: You can request communication through alternative means (e.g., only by mail).

6. Retention of Information
Gait Werx retains client information only as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required by law or professional guidelines.
7. Third-Party Service Providers
We may engage third-party vendors (e.g., scanning tools, secure storage providers) who assist us in delivering our services. All such vendors are required to sign Business Associate Agreements (BAAs) where applicable and to maintain HIPAA-compliant security practices.
8. Children's Privacy
We do not knowingly collect information from individuals under the age of 18 without the explicit consent of a parent or legal guardian.
9. Changes to This Privacy Policy
Gait Werx may update this Privacy Policy from time to time. Changes will be posted on our website and effective as of the “Effective Date” above. Continued use of our services indicates your agreement with the updated terms.
Shipping Policy
At Gait Werx, we are committed to ensuring that your custom foot orthotics are delivered securely, efficiently, and with care. Because every pair is custom-crafted based on individual assessment, our shipping process is designed to reflect the quality and precision of our service.
Shipping Timeline
- Custom Fabrication Time: Orthotics are individually made following your biomechanical evaluation, which includes 3D scans, gait analysis, and related assessments.
- Production typically takes 2–3 weeks after your evaluation and payment.
- You will receive a notification once your orthotics are complete and ready to ship.
Delivery Methods
- Orders are shipped via trackable courier services (e.g., USPS, UPS, FedEx) to ensure reliable delivery.
- Standard shipping is included for most orders unless otherwise specified.
- Expedited shipping may be available for an additional fee upon request.
Shipping Locations
- We currently ship within the United States.
- For shipments outside the U.S., please contact us in advance to discuss availability and options.
Shipping Costs
- Standard shipping is included in the cost of the orthotics unless otherwise stated.
- Additional shipping charges may apply for:
- Expedited delivery
- International destinations
- Remakes or adjustments sent after the initial order, unless covered under warranty or satisfaction guarantee
Lost or Damaged Packages
- If your package is lost or arrives damaged, please notify us within 7 business days of the expected delivery date.
- We will assist in filing a claim with the carrier and, if appropriate, begin a replacement process.
Customer Responsibilities
- Please ensure your shipping address is accurate and complete when placing your order.
- Gait Werx is not responsible for shipping delays or losses due to incorrect address details or changes submitted after dispatch.
Return & Adjustment Policy
At Gait Werx, your comfort is our priority. Every pair of custom orthotics we craft is tailored to your unique needs through in-depth biomechanical assessment. Due to the custom nature of our products, we follow a specific return and adjustment policy:
Satisfaction Guarantee – 60 Days
If you're not satisfied with the fit or comfort of your orthotics:
- You may return for adjustments within 60 days of delivery.
- Up to two (2) adjustments are included at no additional cost during this time.
- If more than two adjustments are necessary, additional shipping charges may apply.
- If you're still not satisfied after adjustments, we may offer a remake or store credit at our discretion.

Returns & Exchanges
Because all orthotics are custom-made:
- Returns and refunds are not accepted except as outlined in the Satisfaction Guarantee or Warranty.
- No returns for damage caused by:
- Misuse or neglect
- Exposure to heat, moisture, or pet damage
- Changes in foot structure or health after fabrication
90-Day Limited Warranty
All orthotics include a 90-day warranty covering:
- Manufacturing defects in materials or workmanship
Does not cover:
- Normal wear and tear
- Improper care or third-party alterations
Warranty claims require:
- Proof of purchase
- Return of the orthotics for evaluation
Adjustment Appointments
- A break-in period of 1–2 weeks is normal.
